الاستعجال في مادة الصفقات العمومية
Résumé: يُعتبر الإستعجال ما قبل التعاقدي في مادة الصفقات العمومية إجراء استثنائيا استحدثه المشرع الجزائري في قانون الإجراءات المدنية والإدارية ، الغرض منه حماية مقتضيات الشفافية في الصفقة العمومية من خلال حماية قواعد الإشهار والمنافسة التي تخضع لها عملية ابرام الصفقات العمومية . واشترط المشرع لإعمال هذا الإجراء بالإضافة إلى توافر الشروط العامة للدعوى الإستعجالية ، شروطا خاصة تتجسد أساسا في خصوصية شرط الصفة بالنسبة للمدعي ، وكذلك شرط الإخلال بالتزامات الإشهار والمنافسة ، كما أخضعه لإجراءات خاصة سواء على صعيد الاختصاص القضائي أو على صعيد السلطات المخولة لقاضي الإستعجال الإداري . Pre-contractual urgency in public bargain article is considered as exceptional measure that the legislator introduced in the code of civil and administrative procedures . it aims at protecting the requirements of transparency in public bargain through protecting publicity and competition regulations which the process of concluding public bargains are submitted to . To put this measure into action , the legislature , in addition to the presence of the general conditions of urgency action , has required special condition that are represented mainly in the specificity of the quality clause required for the plaintiff to the action and also .
