الاستعجال في الصفقات العمومية

Résumé: يقوم الاستعجال في إبرام الصفقات العمومية على تناقض وتقارب قانونين بين إجرائين، إجراء إبرام الصفقات العمومية وإجراء الاستعجال. فالتناقض القانوني يرتبط بإجراءات مطولة في إبرام الصفقات، بينما التقارب القانوني يرتبط بإجراءات استعجالية لمواجهة ظروف استثنائية تتطلب السرعة، وهي بمثابة تفويض للمصلحة المتعاقدة. كما يقوم الاستعجال في إبرام الصفقات العمومية على شروط موضوعية وشروط شكلية: الشروط الموضوعية في إبرام الصفقات: تتمثل في شرطين اساسين أولهما الحادث غير المتوقع واثنيا الاستقلالية. في حين تتمثل الشروط الشكلية هي إجراءات ترتبط بخصوصية الإثبات في الاستعجال الملح وإبرام الصفقة العمومية وفق إجراءات خاصة. The urgency in concluding public transactions is based on the contradiction and convergence of two laws, the procedure of concluding public transactions and the procedures of urgency. The legal contradiction is linked to long-lasting procedures for the conclusion of transactions. While legal convergence is associated with urgent measures to meet exceptional circumstances requiring speed, it serves as a mandate for the contracting interest. The urgency in concluding public transactions is based on objective and formal conditions. The objective conditions in the conclusion of transactions are two conditions: The first condition is related to the unexpected incident and the second condition is related to independence. While the formal conditions in the conclusion of public transactions are procedures, which are related to the specificity of proof in urgent urgency and the conclusion of the public transaction in accordance with special procedures
