المعالجة الجنائية للهجرة غير الشرعية لدى الشباب الجزائري في القانون 09-01

Résumé: أصبحت الهجرة غير الشرعية ظاهرة منتشرة لدى الشباب الجزائري في السنوات الأخيرة، فقد أصبحت الجزائر بالإضافة إلى كونها بلدا مستقبلا وبلد عبور، بلدا مصدرا للهجرة غير الشرعية أيضا، هذا ما دفع بالمشرع الجنائي إلى تجريم الهجرة غير الشرعية في تعديل قانون العقوبات سنة 2009. تظهر أهمية هذا البحث في ارتباطه بحماية أمن واستقرار الوطن من جهة، وحماية الشباب الجزائري من المخاطرة بحياتهم من جهة أخرى، فهذه الدراسة تهدف إلى بيان الأفعال التي تدخل في نطاق الهجرة غير الشرعية والجزاءات المقررة لها. Abstract: Illegal immigration has become a widespread phenomenon among Algerian youth in recent years. Algeria, in addition to being a future country and transit country, has also become a source of illegal immigration. This prompted the criminal legislator to criminalize illegal immigration in the amendment of the Penal Code in 2009 The importance of this research appears in its connection with protecting the security and stability of the homeland on the one hand, and protecting the Algerian youth from risking their lives on the other hand
