حجية الدليل المستمد من التصوير في المكان العام و الخاص في الإثبات الجنائي

Résumé: يتناول هذا المقال حجية الدليل المستمد من التصوير في المكان العام و الخاص في الإثبات الجنائي و قد تم تناول المقال من خلال الإشكالية التالية: إلى أي مدى يمكن اعتبار الدليل المستمد من التصوير في المكان العام و الخاص حجة في الإثبات الجنائي ؟ وما هو موقف المشرع الجزائري من ذلك ؟ و على ضوء هذه الإشكالية، تمّ تناول العناصر المتعلقة بهذا المقال والمتمثلة في مفهوم الحق في الصورة وطبيعتها القانونية. كما تمّ التطرق إلى حجية الدليل المستمد من التصوير العاموالخاص مع تبيان موقف المشرع الجزائري من هذا النوع من الدليل في الإثبات الجنائي، وكذا كل من موقف المشرع الفرنسي والمصري. وقد خلُص المقال في الأخير إلى بعض النتائج والتوصيات علما بأنه تم استخلاص 5 نتائج واقتراح 5 توصيات This article deals with the authoritativeness of evidence derived from filming in public and private places in criminal evidence. The article has been addressed through the following problem: To what extent can evidence derived from filming in public and private places be considered as evidence in criminal evidence? And what is the position of the Algerian legislator on that? In the light of this problem, the elements related to this article, represented in the concept of the right to the image and its legal nature, were addressed. The authoritativeness of the evidence derived from public and private portrayals was also discussed, while clarifying the position of the Algerian legislator on this type of evidence in criminal evidence, as well as the position of the French and Egyptian legislators. Finally, the article concluded with some conclusions and recommendations, noting that 5 conclusions were drawn and 5 recommendations were proposed.
