القيود الـــــــــــــواردة على مبدأ حريـــــــــــــــة الأسعـــــــــار في القانون الجزائري

Résumé: إن إقرار مبدأ حرية الأسعار من خلال الأمر 03-03 المتعلق بالمنافسة هو إقرار بحرية المنافسة التي تقتضي ضمنيا مبدأ حرية التجارة والصناعة وتكرسه، هذا المبدأ الذي يمثل النظام الليبرالي الحر ذلك أن تحديد الأسعار اعتمادا على قواعد المنافسة لا يكون له معنى دون الاعتراف بمبدأ حرية الأسعار. إلا أنه من أصعب المشاكل التي تواجه الحياة الاقتصادية سواء في الماضي أو الحاضر اضطراب الأسواق وارتفاع الأسعار وعدم استقرارها، خاصة بالنسبة للسلع والخدمات الضرورية، وبهدف حماية القدرة الشرائية للمواطن وضبط السوق واستقراره، تتدخل الدولة في تحديد أسعار هذه السلع والخدمات الضرورية، باعتماد آليات قانونية تهدف في مجملها إلى تحقيق أهداف اجتماعية وأخرى اقتصادية للحد أو الوقاية من أي مساس بحرية الأسعار. The endorsement of the principle of freedom of prices through Ordinance 03-03 related to competition is an endorsement of the freedom of competition, which implicitly requires and enshrines the principle of freedom of trade and industry. This principle represents the free liberal system so that setting prices based on the rules of competition does not make sense without recognizing the principle of price freedom. However, one of the most difficult problems facing economic life, whether in the past or present, is market turmoil, high prices and instability, Especially for essential goods and services, With the aim of protecting the purchasing power of the citizen and controlling and stabilizing the market, The state intervenes in determining the prices of these necessary goods and services, By adopting legal mechanisms that aim in their entirety to achieve social and economic objectives to limit or prevent any infringement of free prices.
