تكريس مبدأ حرية الأسعار في التشريع الجزائري

Résumé: تعتبر حرية الأسعار من دعائم المنافسة الحرة والنزيهة التي جاء بها قانون المنافسة حيث لا وجود للمنافسة دون تحرير الأسعار من كل القيود الممكنة، غير أن المشرع الجزائري قيدها ببعض القيود من خلال تحديد أسعار بعض المواد والخدمات أو تجريم بعض الممارسات التي تمس المنافسة والمتعلقة بتحديد الأسعار. ولعل الهدف من هذه الدراسة هي تسليط الضوء على هذا المبدأ كأصل عام، ووقوف على الاستثناءات الواردة عليه. وللإحاطة بهذا المبدأ سيتم الاعتماد على خطة ثنائية مكونة من مبحثين أساسيين والتي من خلالها تم التوصل لعدة نتائج أهمها: -أن مبدأ حرية الأسعار جاء نتيجة لتبني المشرع الجزائري لنظام اقتصاد السوق القائم على حرية المنافسة والتي تقوم بدورها على مبدأ حرية الأسعار. -أن المشرع الجزائري تبنى هذا المبدأ بموجب قانون الأسعار لسنة1989. Freedom of prices is considered one of the pillars of free and fair competition that came in the competition law, as there is no competition without liberating prices from all possible restrictions. Perhaps the aim of this study is to shed light on this principle as a general principle, and to find out the exceptions to it. In order to understand this principle, a bilateral plan will be relied on, consisting of two main topics, through which several results were reached, the most important of which are: - The principle of freedom of prices came as a result of the adoption by the Algerian legislator of a market economy system based on freedom of competition, which in turn is based on the principle of freedom of prices. The Algerian legislator adopted this principle under the Prices Law of 1989.
