الحماية المقررة للمهاجرين غير الشرعيين في ضوء تنامي الهجرة غير الشرعية

Résumé: ملخص: تعد ظاهرة الهجرة غير الشرعية موضوع من المواضيع ذات الصلة الوثيقة بحقوق الإنسان الشخصية التي يجب احترامها في كل الظروف، فالعلاقة بين الهجرة غير الشرعية واحترام حقوق الإنسان علاقة وطيدة، مادامت الهجرة ظاهرة اجتماعية ذات بعد إنساني، فسبب هجرتهم هو بحثهم على حقوقهم الشخصية، لهذا كانت مسألة الحماية الدولية مطروحة على المجتمع الدولي، خاصة بعد الإهمال الشبه التام لهذه الحقوق، بالتغاضي عنها والتزام الصمت حيالها من قبل دول المقصد، حيث لم توجه أي برامج منهجية لمعالجة الدوافع الحقيقية لظاهرة الهجرة غير الشرعية، وأمام ارتفاع الأصوات المنادية بحماية الحقوق الأساسية لهذه الفئة وبخاصة النساء والأطفال، سعى المجتمع الدولي إلى صياغة حلول قانونية لقضية المهاجرين أينما كانوا، معتبرا حقوقهم مسألة إنسانية بالدرجة الأولى، وذلك بغرض رد الاعتبار لهذه الفئة المحرومة من التمتع بأهم الحقوق الإنسانية. Abstract: The illegal immigration is one of the hazardous topics that is closely related to the human rights of individuals, which should be valued and taken into consideration in all circumstances. It is worth mentioning that there is interconnectedness between the illegal immigration and the human rights. Providing that immigration is a social phenomenon with a human dimension, the tangible reason behind the immigration of these individuals could be traced to the fact that they are looking for their inevitable right as human beings. Thus, the protection of human rights kept to be a central part of the international agenda chiefly when these people’s rights were neglected and kept silenced by the host country. Though there are no systematic programs to talk about the actualreasons or objectives behind this phenomenon, in the face of rising voices calling for the protection of the fundamental rights of this group, particularly women and children, the international community has sought to formulate legal solutions to the issue of migrants wherever they may be, considering their rights primarily a humanitarian issue, with a view to restoring the rights of this group, which is deprived of the most important enjoyment of the most important Human rights.
