استغلال العقار الفلاحي عن طريق الامتياز في القانون الجزائري

Résumé: الملخّص: صدر القانون رقم 10-03 المحدّد لشروط وكيفيات استغلال الأراضي الفلاحية التابعة للأملاك الوطنية الخاصة للدولة، بموجبه تمّ إعادة النظر في نمط استغلال العقار الفلاحي وذلك بالتخلّي عن فكرة تأبيد حق الانتفاع على الأراضي الفلاحية وتَبني فكرة استغلالها المؤقّت عن طريق الامتياز، بهدف ضمان الاستثمار المنتج والاستغلال الأمثل لهذه الأراضي. لقد أثار نظام استغلال العقار الفلاحي عن طريق الامتياز العديد من الإشكالات القانونية، الأمر الذي أدى بالسلطات العمومية إلى التدخّل لمعالجتها وإيجاد الحلول القانونية الملائمة لها، قصد ضمان التطهير النهائي للوضعيات التي تُلحقُ ضرراً بالاستغلال العقلاني للأراضي الفلاحية وتحقيق الأمن العقاري للمستغلين الحقيقيين. Abstract: Law number 10-03, which specifies the conditions and modalities for the exploitation of agricultural land under the state's private property, was promulgated in 2010, in which a new way of exploiting agricultural land is planned, and to abandon the idea of usufruct in favor of temporary exploitation by concession and this, in order to guarantee a profitable investment. The système of exploitation of agricultural property by concession has raised many legal problems, which has led the authorities to intervene to resolve theme find appropriate legal solutions, to ensure the definitive purification of the conditions that rational exploitation of agricultural land and real estate security for the real exploiters.
