التوازن العقدي في عقد المقاولة من الباطن

Résumé: نستخلص من خلال ما تطرقنا في هذا الموضوع، ان عقد المقاولة من الباطن يرتب اثاره بمجرد انعقاده فيتعين على كل من المقاول الأصلي والمقاول من الباطن تنفيذ التزاماته العقدية تحت طائلة تحمل مسؤولية الاخلال بذلك. حيث نجد ان المشرع الجزائري قد رتب على عاتق المقاول الأصلي والمقاول من الباطن مجموعة من الالتزامات يتعين على كل منهما ان ينفذها تطبيقا لبنود عقد المقاولة وبحسن النية. إضافة الى ذلك جعل المشرع الجزائري للمقاول من الباطن مجموعة من الحقوق المقررة فان تضمن له حقه اتجاه المقاول الأصلي ورب العمل حيث جعل له في حق رفع دعوى قضائية مباشرة ضد رب العمل لتحصيل حقوقه وكذا الحق في الامتياز في حالة توقيع الحجز بين يدي رب العمل باعتباره ضمانا اخر للمقاول من الباطن، حتى يستوفي حقه مهما كانت الأحوال والنزاعات المحتمل حدوثها ويكون للمقاول من الباطن حق التقدم في مواجهة جميع الدائنين We conclude from what we discussed in this topic that the subcontracting contract has its effects as soon as it is concluded, so both the original contractor and the subcontractor must implement their contractual obligations under pain of bearing the responsibility for breaching this. Where we find that the Algerian legislator has arranged for the original contractor and the subcontractor a set of obligations that each of them must implement in application of the terms of the contracting contract and in good faith. In addition, the Algerian legislator made the sub-contractor a set of established rights, which guarantees him his right towards the original contractor and the employer, as it gives him the right to file a direct lawsuit against the employer to collect his rights, as well as the right to a concession in the event of seizure in the hands of the employer as a guarantee Another for the subcontractor, so that he fulfills his right, whatever the circumstances and possible disputes that may arise, and the subcontractor has the right to advance against all creditors.
