العلاقة بين رب العمل والمقاول من الباطن في القانون الأردني

Résumé: تعددت أشكال المقاولة وصورها في العصر الحاضر، وكثر الإقبال عليها سواء على الصعيد الحكومي أو على الصعيد الخاص، ولهذا العقد طرفان هما رب العمل والمقاول الأصلي، وفي بعض الحالات قد يلجأ المقاول الأصلي إلى المقاول من الباطن، والأصل هنا أنه لا تقوم أي علاقة مباشرة بين رب العمل وبين المقاول من الباطن وإنما التعاقد يربط رب العمل بالمقاول الأصلي بعقد المقاولة الأصلي اما المقاول الأصلي والمقاول من الباطن فيربطهما عقد المقاولة من الباطن . تهدف دراستنا هذه إلى توضيح العلاقة التي تربط المقاول من الباطن برب العمل وكيف يمكنه الرجوع على رب العمل للحصول على ما يستحقه بموجب عقد المقاولة من الباطن، وعليه فقد تم التركيز على توضيح ثلاث أمور ألا وهي دعوى الحوالة والدعوى غير المباشرة والدعوى المباشرة وحق الامتياز المقررين لعمال المقاول من الباطن بموجب قانون العمل الأردني . There are many forms of contracting in the present, and there is a lot of demand for it at the governmental level and at the private level. This contract has two parties, the employer and the original contractor, and in some cases the original contractor may turn to the sub-contractor, and the principle here is that no direct relationship exists between The employer and the subcontractor, but the contract links the employer to the original contractor with the original contract of contract, whereas the original contractor and the subcontractor are linked by the subcontracting contract. Our study aims to clarify the relationship between the subcontractor and the employer and how he can refer to the employer to obtain what he deserves under the subcontracting contract. Therefore, it was focused on clarifying three things, namely, the transfer case, the indirect claim, the direct claim, and the right of privilege established for the workers of The sub-contractor under the Jordanian Labor Law.
