أهميــــة تدريس علمي الفقه وأصول الفقه في كليــات الحقـوق The Importance Of Teaching Both Of Islamic Jurisprudence And Principals Of Islamic Jurisprudence In The Faculties Of Law

Résumé: الملخص بالعربية: تكمن أهمية تدريس علمي الفقه وأصول الفقه في كليات الحقوق؛ كونهما من أعظم العلوم الإسلامية التي لا يستغني عنهما رجال القانون الذين يرومون فهم النصوص والوثائق القانونية بطرق سليمة، وتفسيرها تفسيرا دقيقا، فيعرفون منطوقها ومفهومها، وعمومها وخصوصها، ومطلقها ومقيدها...، الأمر الذي يوصلهم إلى استنباط الأحكام العملية من أدلتها التفصيلية بدون خطأ. فهما المحضن الجامع للمنهجية العلمية والعملية للتفكير الإسلامي، فأصول الفقه: يبحث في أدلة الأحكام الإجمالية، وقواعد الاستنباط، وكيفية الوصول إلى الحكم الشرعي العملي المناسب. والفقه: يعين على استنباط الأحكام على ضوء المناهج التي رسمها علم الأصول، وبتطبيق القواعد التي قررها، وهي مهمة لعمل القاضي، وهو ما ينبغي أن يتعلمه طالب الحقوق. الكلمات المفتاحية: الفقه الإسلامي، أصول الفقه، الأحكام الشرعية العملية، الاستنباط، الاجتهاد. Abstract: The importance of teaching Jurisprudence and the Principles of Jurisprudence in the Faculties of law lies in the fact that they are one of the greatest Islamic Sciences, which are indispensable for lawmen. Lawmen who aspire to understand texts in proper ways, and to interpret them accurately. As a result they know their logic and their concept, their generality and their specifity and the absolute and the restricted. These lead them to devise practical judgments from their detailed evidence without errors. Jurisprudence and the Principles of Jurisprudence are the comprehensive incubator of the scientific and practical methodology of Islamic thought. The principles of Jurisprudence examines the evidence of general provisions and the rules of reasoning. Jurisprudence is used to draw judgments in the light of curricula which is drawn by the Principles of Jurisprudence and the application of rules that it decided.
