استحسانات الإمام مالك -دراسة فقهية تأصيلية-

Résumé: الملخص: تتناول هاته الدراسة مجالا محدودا، من مجالات الاستحسان في الفقه الإسلامي، وذلك رغم اتساعه واحتوائه للكثير من المسائل الفقهية، حتى قال عنه الإمام مالك: "أنه تسعة أعشار العلم"، لتبرز أهمية الاستحسان، بعد تعريفه اللغوي والاصطلاحي، ومكانته في جانب التشريع الإسلامي، مركزة على استحسانات الإمام مالك، موضحة هاته الاستحسانات في جانبها الفقهي التأصيلي، رغم قلتها؛ فقد وضحت لنا من خلال صاحبها ومكانته العلمية؛ أن الاستحسان وإن اختلف فيه من قبل العلماء، هو أصل من أصول التشريع، وتمثلت هاته الاستحسانات في خمس مسائل لم يسبقه غيره إليها. Abstract: This study deals with a limited field of appreciation in Islamic jurisprudence, despite its width and that it contains many issues of Islamic jurisprudence, what lead Imam Malik to say: '' It is nine-tenths of science .'' ; to highlight the importance of appreciation, after it has been defined both in language and in terminology, as well as its position in Islamic legislation. Focusing on the appreciations of Imam Malik, explaining these appreciations in its jurisprudence side, although its fewness. So it has explained to us through its owner and his scientific status that the appreciation, even if it has not been agreed-upon among scolars, it is one of the principles of Islamic legislation. Such appreciations were represented in five issues, no one has preceded him (Imam Malik) to them.
