المسؤولية القانونية عن الخطأ الطبي في الجراحة القيصرية

Résumé: كثيرة هي الأخطاء الطبية التي تضع حد لحياة المرضى،أو تتسبب لهم في عاهات مستدامة أو تفقدهم للآبد وانتشرت هذه الظاهرة بشكل رهيب في الآونة ألأخيرة مما استدعى بالمسؤولين إلى دق ناقوس الخطر في الجزائر ، والأخطاء الطبية مصطلح يجهله الكثير من المواطنين فمن بين الضحايا الكثيرة في المجتمع يجهلون متابعة الطبيب قضائيا كما أن غياب الثقافة القانونية وسط أفراد مجتمعاتنا أدى بالكثير إلى التستر عن هذه الجريمة ألشنعاء ومن بين الأخطاء المرتكبة من قبل بعض الأطباء تتعلق بالنساء أثناء العمليات ألقيصرية فقد يؤدي إهمال الطبيب أو رعونته أو عدم أخذ الاحتياط إلى وفاة المرأة والجنين أو إصاباتهم بجروح أو عاهات تسبب لهم أضرار جسيمة. المشرع الجزائري لم يغطي هذه الجريمة الشنعاء حتى ولو كانت عن طريق الخطأ مما جعل القاضي يلجأ إلى القواعد العامة الموجودة في قانون العقوبات. Among the many victims in society, they are ignorant of pursuing the doctor judicially, and the absence of legal culture among members of our societies has led a lot to cover up this heinous crime and among the mistakes committed by some doctors related to women during cesarean operations, it may lead to neglect The doctor or his care, or failure to take precaution, to the death of the woman and the fetus, or their injuries or disabilities, which cause them severe damage. The Algerian legislator did not cover this heinous crime even if it was in error, which led the judge to resort to the general rules found in the penal code.
