راسة تحليلة للتوجه التشريعي نحو تكريس الإقتصاد الدائري على ضوء أحكام قانون رقم 01-19 المتعلق بتسيير النفايات و مراقبتها و ازالتها

Résumé: تهدف هذه الدراسة إلى تبيان التوجه التشريعي نحو الإقتصاد الدائري من خلال إعتماد الاليات القانونية لإعادة تدوير النفايات و رسكلتها نحو متوجات صالحة لإستعمال و الإستهلاك، و تمثلت هذه الآليات القانونية في تبني المشرع الجزائري النظام الرقابة الإدارية القبلية و البعدية على النشاط الصناعي لمنتج النفايات، و من جهة أخرى تبني الآليات الوقائية أو التحفيزية التي من شأنها دفع منتج النفايات و تحفيزيه لرسكلة النفايات التي ينتجها، و التي تجلت في إبرام العقود البيئية و فرض النظام الجبائي البيئي عن طريق فرض الضرائب و الرسوم البيئية و الإعانات البيئية التي تجلت في الإعفاء من الضرائب و تقديم الإعانات. رغم تكريس المشرع الجزائري النظام القانوني لإعادة تدوير النفايات و رسكلتها بموجب القانون رقم 01-19 المتعلق بتسيير النفايات و مراقبتها و إزالتها، فأن هذا الأخير أضحى يعتريه بعض الصعوبات تحول دون فعاليته من بينها إنعدام الثقافة البيئية التي تعجل نحو تكريس الآليات الوقائية لإعادة تدوير النفايات، عدم فعالية منشآت معالجة النفايات لقلة التمويل و الخبرة في هذا المجال، يغلب على هذا القانون آليات الضبط الإداري من شأنها شل سياسة الإستثمار في مجال تدوير النفايات. ABSRACT: his study aims to demonstrate the legislative orientation towards the circular economy through the adoption of legal mechanisms for recycling waste and sodomizing it to the desirable directions of use and consumption And these legal mechanisms were the adoption by Algerian legislature of the system of tribal and remote administrative control of the industrial activity of the waste product, On the other hand, it adopts preventive or catalytic mechanisms that will drive the waste product and stimulate it to sink the waste it produces. s Development ", which was manifested in the conclusion of environmental contracts and the imposition of the ecosystem through taxation, environmental fees and subsidies manifested in tax waivers and subsidies. Although the Algerian legislature has established the legal regime for the recycling and recycling of wastes under Act No. 01-19 on the management, control and removal of wastes, environmental culture, which accelerates the dedication of preventive waste recycling mechanisms, Ineffective waste treatment facilities for lack of funding and expertise in this area policy ", this law predominates administrative control mechanisms that will paralyse the investment policy in waste recycling.
