الحماية القانونية للمستهلك الإلكتروني في الجزائر

Résumé: مع التطور التكنولوجي واستعمال الوسائل الإلكترونية وشبكات الإنترنت، نتج عنه عدة تغييرات في التجارة ، والتي برز عنها ما يسمى بالمبادلات الإلكترونية، التجارة الإلكترونية، المستهلك الإلكتروني، التعاقد عن بعد، المورد...وغيرها من المفاهيم والمصطلحات الحديثة. ويعتبر المستهلك من أبرز وأهم العناصر في الاقتصاد الدولي ، واهتمت به كل الأنظمة القانونية بالعالم ، وتطورت وسائل حمايته بمرور الزمن ، وكان ولازال من المواضيع الهامة في المجتمعات الدولية. إن حماية المستهــــلك الالكتروني تستوجــــب إحاطـــته بكافــة الوسائـــل والآليات القانونيــة ، لتوفيـــر له الحماية الكافية ، وتضمن مصالحــــه ، وحقوقه. توجهت أغلب الدول في إطار الحماية إلى آليات قانونية ومنها الجزائر، حيث حاولت أن تُجاري الدول التي سبقتها في مجال حمــاية المستهلك الإلكتروني ، وذلك لضمان حقوقه في ظل الانفتاح الرهيب على الأسواق الإلكترونية وإبرام العقود عن بعد، ، تلبية للرغبات الشخصية و المهنية للمستهلك الإلكتروني ، وأيضا لحمايته الجنائية ، ضد كل الجرائم الماسة بخصوصيته ، وحقه في الأمن من أخطار التجارة الإلكترونية ، و الإخطار التي تمسه خلال إبرامه للعقود الإلكترونية. وشهدت الجزائر مؤخرا تطوراً في تشريع القوانين الخاصة بحماية المستهلك وضمان مصالحه، نظرا لأهمية ومكانة المستهلك الإلكتروني على جميع المستويات الاقتصادية ، الاجتماعية والسياسية. الكلمات المفتاحية: الحماية القانونية- المستهلك الإلكتروني- التجارة الإلكترونية- العقد الإلكتروني. Abstract: With technological development and the use of electronic means and Internet networks, it has resulted in several changes in commerce, which have emerged from so-called electronic exchanges, e-commerce, e-consumer, remote contracting, supplier... and other modern concepts and terminology. The consumer is one of the most prominent and important elements of the international economy, and all the world's legal systems have paid attention to it, and its means of protection have evolved over time, and it has been and continues to be an important topic in international societies. The protection of the electronic consumer requires that it be informed by all legal means and mechanisms to provide it with adequate protection, safeguarding its interests and rights. Most States have approached legal mechanisms, including Algeria, within the framework of protection. e-consumer protection ", in which it tried to conduct its predecessors in the area of e-consumer protection, In order to guarantee its rights in light of the terrible openness to electronic markets and the conclusion of remote contracts to meet the personal and professional desires of the electronic consumer, and also for his criminal protection, against all crimes that are pernicious to his privacy, his right to security from the dangers of electronic commerce, and the notification that affects him during his conclusion of electronic contracts. Algeria has recently witnessed an evolution in the legislation on consumer protection and safeguarding of consumer interests, given the importance and standing of e-consumers at all economic, social and political levels.
