الرقابة على قرارات مجلس المنافسة

Résumé: يتمتع مجلس المنافسة سلطات عديد كإصدار الأوامر والفصل في الدعاوى الممارسات المقيدة للمنافسة وتوقيع الجزاءات المالية واتخاذ الإجراءات التحفظية إلا أن للقاضي دور في رقابة مجلس المنافسة الذي يتقاسم معه مهمة السهر على حماية المنافسة إلا أنه ما يعاب على المشرع الجزائري هو توزيع الاختصاص القضائي في رقابة على أعمال مجلس المنافسة بين القضاء العادي والقضاء الإداري حسب طبيعة القرار الذي يصدر من مجلس سواء قرار بمنح أو رفض ترخيص بالتجميع فيحيل الاختصاص إلى مجلس الدولة بمعنى القاضي الإداري أو الأحكام الصادرة منه والمتعلقة بالفصل في دعوى الممارسات المقيدة للمنافسة فيحيل الاختصاص إلى مجلس قضاء الجزائري بمعنى القاضي العادي . فاختصاص القاضي العادي في النظر في القرارات الصادرة عن مجلس المنافسة غير مقبولة خاصة بعد نزع التجريم عن الممارسات المنافية للمنافسة وعليه نقترح توحيد الاختصاص القضائي ومنح القضاء الإداري وحده حق الرقابة القضائية على أعمال مجلس المنافسة سواء القرارات الإدارية أو القرارات الفاصلة في الدعوى الممارسات المقيدة للمنافسة.The Competition Council has many powers، such as issuing orders, adjudicating cases practices restricting competition، imposing financial penalties and taking precautionary measures. However، the judge has a role in the control of the Competition Council، with which he shares the task of ensuring the protection of competition. However، what is wrong with the Algerian legislator is the distribution of jurisdiction in the supervision of the work of the competition. The competition council between the ordinary judiciary and the administrative judiciary, according to the nature of the decision issued by the council, whether a decision granting or refusing a license to collect، it refers the jurisdiction to the Council of State، meaning the administrative judge or the rulings issued by it related to deciding the case of practices restricting competition, so it transfers jurisdiction to the Algerian Judicial Council, meaning the ordinary judge. The competence of the ordinary judge to consider the decisions issued by the Competition Council is not acceptable، especially after the decriminalization of anti-competitive practices. Therefore, we suggest the unification of judicial jurisdiction and granting the administrative judiciary alone the right of judicial oversight over the work of the Competition Council, whether administrative decisions or decisions adjudicating in the case the practices restricting competition
