مدى فعالية آليات الإستجواب ولجان التحقيق البرلمانية وفقا للتعديل الدستوري الجزائري لسنة 2020

Résumé: ملخص: من المعلوم أنه توجد في الأنظمة الدستورية البرلمانية ترسانة هامة من الوسائل والآليات التي تستعملها السلطة التشريعية بهدف تحقيق غاية مشتركة وهي الرقابة على أعمال الحكومة، ومن هذا المنطلق نجد أن المشرع الدستوري قد إعترف للبرلمان الجزائري بحق الرقابة، وهذا لتمكين الشعب مباشرة عن طريق ممثليه المنتخبين من تقييم أداء الحكومة ومحاسبتها عن تصرفاتها، ومدى إلتزامها بتعهداتها التي قطعتها أمام مواطنيها. وفي هذا الإطار نجد عدة آليات دستورية، ولعل من بينها الإستجواب البرلماني الذي يعد من أخطر وسائل الرقابة على أعمال الحكومة، بحيث أنه ليس مجرد طلب للمعلومات والإستفسار، بل يتعدى ذلك كونه يتضمن محاسبة وإتهام للحكومة، وكذلك لجان التحقيق البرلمانية المكونة من أعضاء ينتخبهم البرلمان، هدفهم الكشف عن كافة العناصر المادية والمعنوية في مسألة أو قضية ذات مصلحة عامة. Abstract: It is known that in parliamentary constitutional systems there is an important arsenal of means and mechanisms used by the legislative authority in order to achieve a common goal, which is to monitor the work of the government. Evaluate the performance of the government and hold it accountable for its actions, and the extent of its commitment to the commitments it made to its citizens. In this context, we find several constitutional mechanisms, and perhaps among them is parliamentary interrogation, which is one of the most dangerous means of oversight over the government’s work, as it is not just a request for information and inquiry, but goes beyond that as it includes accountability and accusation to the government, as well as parliamentary investigation committees, which are a form of oversight. The investigation is carried out by Parliament over the government, so that the investigation is carried out by a committee composed of members elected by Parliament, whose objective is to reveal all material and moral elements in a matter or issue of public interest.
