الحماية الجزائية للطفل المتشرد في القانون الجزائري

Résumé: ملخص: تتمثل الحماية الجزائية للطفل المتشرد في الحماية الموضوعية والحماية الاجرائية، حيث تظهر الحماية الجزائية الموضوعية من الخلال المركز القانوني الذي مُنح للطفل المتشرد، حيث اعتبره المشرع الجزائري في المادة 2 من قانون 15-12 بأنه طفل معرض للخطر وليس بطفل جانح رغم أن التشرد جريمة يعاقب عليها قانون العقوبات؛ كما تظهر من خلال تجريم المشرع الجزائري لعدة أفعال تقوم بها الأسرة أو الغير، تتسبب بشكل كبير في تشرد الطفل، من بينها ترك الطفل في الشارع، واهمال الأسرة والتسول بالطفل أو دفعه للتسول. أما الحماية الجزائية الاجرائية فتتجسد من خلال المواد من 32 إلى 45 من قانون حماية الطفل 15-12، حيث نصت بشكل دقيق على اجراءات رفع دعوى الحماية للطفل المتشرد ومراحلها، والتي يمكن أن نستشف منها الدور الفعال لقاضي الأحداث في توفير الحماية اللازمة للطفل المتشرد. Abstract The criminal protection of the vagrantchildisdividedinto objective protection and procedural protection , where the objective penal protection is the thelegalstatusgranted to the vagrantchild , where the algerianlegislator , in article 2 of act12-15 , considerhim a childatrisk and not a dilinquentchilddespite the factthathomelessnessis a crime punishable by the penel code. This protection alsoappearsthroughcriminalization the algerianlegislator to the actions of the family or society whichpushes the child to go to the streetnd one of hugenumbers of reasonisleaving the child in the street for somanyhours and the neglection of the family to the childpusheshim to begarry or pushinghim to mendicancy. The proceduralpenalprotecionisembodied in the provisions of the childlaw of article 32to article 45, whereitprovides a precise description of the procedures for the prosecution and stage of the protection of the vagrentchild as wediscoverthroughtheseprocedures the effective role of the juvenilejudge in providing the necessary protection for the homelesschild.
