المحكمة الدستوري في الجزائر

Résumé: الملخص: تناولت هذه الدراسة المحكمة الدستورية في الجزائر، من خلال تسليط الضوء على الاطار التنظيمي للمحكمة الدستورية وذلك بالقيام بتحديد تشكيلة المحكمة الدستورية وشروط العضوية فيها، هذا ولم تقتصر هذه الدراسة على الاطار التنظيمي للمحكمة الدستورية، بل تمتد لتشمل الاطار الوظيفي للمحكمة الدستورية من خلال الوقوف على الاختصاص الرقابي للمحكمة الدستورية والذي يشمل الرقابة الالزامية والاختيارية على دستورية الاختصاص التشريعي للبرلمان، بالإضافة إلى الرقابة على دستورية التنظيمات والأوامر الرئاسية والدفع بعدم الدستورية. وكما اشارت الدراسة الى الاختصاصات الاخرى للمحكمة الدستورية والتي تتمثل أساسا في الاختصاص الانتخابي والاختصاص الاستشاري وتفسير بنود الدستور والنظر في الخلافات بين السلطات الدستورية. وخلصت هذه الدراسة في النهاية الى عدد من النتائج والتوصيات. Abstract : This study dealt with the Constitutional Court in Algeria, by shedding light on the organizational framework of the Constitutional Court by determining the composition of the Constitutional Court and the conditions for membership in it. This study was not limited to the organizational framework of the Constitutional Court, but rather extends to include the functional framework of the Constitutional Court by examining the supervisory jurisdiction of the Constitutional Court, which includes mandatory and optional oversight of the constitutionality of the legislative jurisdiction of Parliament, in addition to oversight of the constitutionality of regulations and presidential orders and the defense of unconstitutionality. The study also referred to the other jurisdictions of the Constitutional Court, which are mainly represented in electoral jurisdiction, advisory jurisdiction, interpretation of constitutional provisions, and consideration of disputes between constitutional authorities. This study ultimately concluded with a number of results and recommendations
