دسترة المحكمة الدستورية كبديل للمجلس الدستوري في الجزائر خطوة جديدة لتفعيل الرقابة على دستورية القوانين ومبدأ الفصل بين السلطات.

Résumé: يحتل الدستور قمة الهرم في المنظومة القانونية للدولة، ذلك لأنه يصون الحقوق والحريات المتعلقة بالأفراد ويحدد عمل السلطات الأمر الذي يحتم احترامه وسموه على كافة القواعد القانونية الأدنى درجة منه وهذا الأمر لا يتأتى إلا من خلال وجود هيئات لممارسة الرقابة على دستورية القوانين والتي يمارسها إما المجلس الدستوري أو المحكمة الدستورية كما فعلت الجزائر مؤخرا من خلال مشروع التعديل الدستوري لسنة 2020. The constitution occupies the top of the pyramid in the legal system of the state, because it preserves the rights and freedoms related to individuals and defines the work of the authorities, which must be respected and superior to all legal rules of lower degree than it, and this matter can only be achieved through the existence of bodies to exercise control over the constitutionality of laws that are exercised by either the Constitutional Council Or the Constitutional Court, as Algeria recently did through the draft constitutional amendment for the year 2020.
