Résumé: ملخص: تنحل الرابطة الزوجية بالطلاق ويتم بإرادة الزوج كما يصدره القاضي تلبية لطلب الزوجة اذا استوفت الشروط المنصوص عليها فقها وقانونا، نص المشرع الجزائري على أنواعه ضمن المادة 48 من قانون الأسرة الجزائري المعدل بالأمر 05-02 . وفي حكم الشريعة الإسلامية للزوج حق إيقاع الطلاق بالإرادة المنفردة،وللقاضي صلاحية التفريق بين الزوجين لكن ليس له أن يجبر الزوج على إمساك زوجته وهو كاره لها، وقد جاء نص المادة 49 ليقرر أن الطلاق لا يثبت ألا بحكم فكيف يمكن الجمع بين نص المادة 49 وأحكام الفقه والقانون في الطلاق؟ وكيف يثبت الطلاق وفق نص المادة 49؟ وماهي آثاره ؟ الكلمات المفتاحية: الطلاق بالإرادة المنفردة؛ اثبات؛ حكم القاضي؛ الطلاق في الشريعة الإسلامية). Abstract: The marriage bond is dissolved by divorce and is carried out at the will of the husband, as issued by the judge at the request of the wife, if the conditions provided for are met. The Algerian legislature states its types under article 48 of the Algerian Family Code, as amended by order No. 05-02. In the Islamic sharia, the husband has the right to divorce by unilateral will. The judge has the power to make a distinction between the spouses, but he cannot force the husband to hold his wife in contempt of her. Article 49 states that divorce can only be established by virtue of how the text of article 49 can be combined with the provisions of jurisprudence and the law in divorce. How can divorce be established in accordance with article 49? And what's the effect of it? .
