وقوع الطلاق وثبوته في الفقه الإسلامي وقانون الأسرة الجزائري

Résumé: ملخص: اختلف فقهاء القانون في تفسير معنى الثبوت الوارد في نص المادة 49 من قانون الأسرة، فذهب بعضهم إلى أن معناه هو وقوع الطلاق، والحكم القضائي منشئ له، وهو تفسير مخالف لأحكام الشريعة الإسلامية، باعتبار أن الطلاق يقع بإرادة الزوج، والحكم القضائي حكم كاشف له، على خلاف التطليق الذي يكون بطلب من الزوجة لأسباب حددتها الشريعة الإسلامية والقانون، كذلك فإن المعنى اللغوي للوقوع والثبوت مختلف تماما، وهو يتماشى مع ما تقتضيه الشريعة الإسلامية في ذلك من أحكام، إضافة إلى دلالة النصوص القانونية، والأحكام الشرعية المتعلقة ببدء سريان العدة وانتهائها تفرض وقوع الطلاق بإرادة الزوج وثبوته قضاءً. كلمات مفتاحية: الطلاق، وقوع، ثبوت، قانون الاسرة، الفقه الإسلامي.
