تعريف الشعوب الأصلية شرط أم مفارقة

Résumé: إن القانون الدولي لم يعط لفكرة الشعوب الأصلية نظرية متكاملة تفرض نفسها على الصعيد الدولي، ؛وذلك لصعوبات قد يكون من ضمنها صعوبة تحديد مفهوم الشعوب الأصلية، إذ أنه في كل دولة يوجد فيها سكان أصليين تختلف المصطلحات التي تطلق على هذه الجماعة، وما يزيد من صعوبة التحديد تعدد زوايا النظر إلى هذا المصطلح، منها التاريخي والثقافي، والاجتماعي، وحتى القانوني، ضف إلي ذلك إن القانون الدولي كان يعتبر أن تنظيم العلاقات بين الدول ومواطنيها من الشؤون التي تندرج في إطار اختصاص الدولة الداخلي. و الهدف من الدراسة تحديد مفهوم الشعوب الاصلية وضبط الفرق بينها وبين المفاهيم الاخرى، بالاستناد الى معايير الامم المتحدة. الكلمات المفتاحية: السكان الاصلين، الشعوب الأصلية، حقوق الانسان، حق الشعوب، الاقليات الاصلية. Abstract : International law has not given the idea of indigenous peoples an integrated theory that imposes itself at the international level, due to difficulties, including the difficulty of defining the concept of indigenous peoples, since in every country where there are indigenous peoples, the terms used for this group differ, and what increases the difficulty of determining There are many angles of view of this term, including historical, cultural, social, and even legal. In addition, international law considered that the regulation of relations between states and their citizens is a matter that falls within the framework of the internal jurisdiction of the state. The aim of the study is to define the concept of indigenous peoples and to control the difference between them and other concepts, based on the standards of the United Nations.
