مظاهر العرف وأثرها في طرق تأديب الناشز – أحكامه وضوابطه – دراسة مقارنة في ضوء أحكام الفقه الاسلامي وقانون العقوبات العراقي

Résumé: ملخص: من المعلوم أن الله سبحانه وتعالى قد شرع أحكاماً لعباده كِفل لهم عند تطبيقها السلامة في الدنيا والفلاح في الآخرة، ومن هذه الاحكام فقه الأحوال الشخصية ومن أهمها الحقوق المشتركة بين الزوجين، ويسلط هذا البحث على جزئية من جزئياتها وهو ( مراعة العرف في حق تأديب الرجل زوجته ) وهو الحق الذي شغل مساحة مهمة من المعالجات الفقهية. واتماماً للصورة الواقعية لهذا البحث ليكون حيز التطبيق، فأن قانون الأحوال الشخصية في العراق وأغلب البلاد الاسلامية يستمد نصوصه من نصوص الشريعة الاسلامية وروحها باعتبارها أحد مصادر تشريعها ثنينا بما نص عليه القانون العراقي لمعالجة مسالة التأديب فإن لراعي الاسرة - الزوج - سلطة على باقي أفرادها ليستطيع بمقتضاها أن يحمل باقي افرادها على السلوك القويم ليقصد بالتأديب الاصلاح والتهذيب وهو ما تهدف اليه أحكام الشريعة الاسلامية وكذلك القوانين الوضعية، ولا شك أن تأديب الرجل زوجته حق له شرعاً، وبما يقتضيه العرف وكذلك التشريعات الوضعية لبعض الدول، في حين يعد هذا الضرب سبباً للتفريق في بعض القوانين الاخرى، والهدف هو الحفاظ على الأسرة لتتأكد الحقيقة التي تثبت أن العقل الانساني لا بد له من الحاجة الى التشريع الالهي الحكيم . Abstract: It is known that God Almighty had begun provisions for slaves to ensure them when they applied to safety in this world and the luck in the hereafter. These verdicts jurisprudence of personal status which the most important is common rights between spouses. So this research highlights of a partial fractions which (Give more attention to custom in the right to discipline the man his wife ) It is the right، that served an important area of jurisprudence processors. It is completely for picture of realism of this search to be entered into the application، the Personal Status in Iraq Law and most of the Islamic countries derives texts of Islamic texts and spirit as one source of legislation insure to the provisions of Iraqi law to address the issue of discipline is the patron of the family - the husband - authority over the rest of its members to be able whereby to carry the rest of its members on the ethical conduct of intended discipline reform and discipline which aims to him the provisions of Islamic law، as well as man-made laws، no doubt to discipline the man his wife right of him legally، and are required by custom as well as man-made laws of some countries، while this beating is a reason to break up in some other laws، the goal is to keep the family to make sure the truth that proves the human mind needs a Hakim Divine legislation.
