أحكام الطلاق الرجعي و آثاره -دراسة مقارنة بين الفقه الاسلامي و قانون الاسرة الجزائري

Résumé: قد يحصل الطلاق والزوج في حالة غضب وهيجان، وقد يصدر منه التلّفظ به دون ترّوٍ وحُسبان لعواقبه الوخيمة التي ترجع بالسلّب على الزوجة والأبناء، ومن سماحة الإسلام أنّه شرّع الرّجعة للحياة الزوجية وذلك من خلال ما يُعرف بالطلاق الرجعي، الذي لم تترك الشريعة الإسلامية أحكامه دون تنظيم وتوضيح، وذلك مقارنة بالقوانين الوضعية، فنجد أنّ المشرّع الجزائري لم ينص في قانون الأسرة الجزائري صراحةً على أحكام الطلاق الرجعي، وإنّما أشار في المادة (50) من نفس القانون إلى أحد آثاره المتمثلة في حق الزوج بإعادة زوجته إلى عصمته، ونجد أنّه أشار أيضاً في المادة(51) إلى أحد شروط الطلاق الرجعي بشكل ضمني. فمن الملاحظ أنّ المادة (50) تحتاج إلى إعادة صياغتها وتعديلها والتدقيق فيها وذلك من أجل أنّ تتضح أحكام الطلاق الرجعي لمّا لها من أهمية بالغة على الأسرة. "Divorce may take place while the husband is in a state of anger and agitation, and he may utter it without taking into consideration its dire consequences that negatively affect the wife and children.so the Islam permitted the return to marital life through what is known as revocable divorce, which was not left without regulations and clarification by the Islamic Sharia compared to man-made laws. We find that the Algerian legislator did not explicitly stipulate the provisions of revocable divorce in the Algerian family law. But it referred in Article (50) of the same law to one of its effects represented in the husband is right to return his wife to his marriage bond. And it also referred in Article (51) to one of the revocable divorce conditions in an implicit way. It is noted that Article (50) needs to be reformulated, amended and scrutinized in order to clarify the provisions of revocable divorce since it has a great importance to the family."
