صيغة السكن الترقوي كوسيلة لحل مشكلة السكن في الجزائر

Résumé: يعد الطلب المتزايد على السكن في الجزائر من أهم التحديات التي واجهتها الدولة الجزائرية، حيث سعت مختلف الحكومات المتعاقبة منذ الاستقلال عن حلها، بالنظر لكونها احد المقتضيات الاجتماعية التي راهنت الدولة الجزائرية على توفيرها وتسخير الإمكانات المالية والتشريعات القانونية الكفيلة بإعتماد طرق البناء والتشييد وفق صيغ متعددة، حيث لجأت الدولة في سبيل حل هذه الأزمة الحادة إلى اعتماد آلية قانونية تمثلت في صيغة السكن الترقوي، من خلال توجيه هده الصیغة السكنیة إلى الطبقة الاجتماعیة المتوسطة، وقد ساهمت بشكل فعال في إنعاش قطاع السكن والتخفيف من حدة الأزمة السكنية، علاوة على انعاش المجال الاقتصادي المرتبط بالاشغال العمومية وعملية البناء لمختلف المرافق المجاورة للاحياء والتجمعات السكنية الحضرية ضمن صيغة السكن الترقوي وبذلك فإن هذه الورقة البحثية تهدف على البحث في مضمن صيغة السكن الترقوي وعرض اهم الإيجابيات المناجمة عن اعتماد هذه الصيغة، وبيان دور المرقين العقاررين في عملية تشييد السكنات وفق هذه الصيغة، وبيان الوكالات والأجهزة العمومية المعتمدة من اجل تنظيم عملية البناء، علاوة على تسليط الضوء على مضمون العقد الناجم عن الصيغة السكنية في ظل نظام السكن الترقوي. الكلمات المفتاحية: السكن، السكن الترقوي، قطاع السكن، المرقي العقاري، العمران، تشييد البنايات Abstract: The increasing demand for housing in Algeria is one of the most important challenges facing the Algerian state, as various successive governments have sought to solve it since independence, given that it is one of the social requirements that the Algerian state has bet on providing and harnessing the financial capabilities and legal legislations capable of adopting construction and building methods according to multiple formulas, as the state resorted to adopting a legal mechanism represented in the formula of promotional housing, by directing this housing formula to the middle social class. By directing this housing formula to the middle social class, it has effectively contributed to reviving the housing sector and alleviating the housing crisis, in addition to reviving the economic field related to public works and the construction process of various facilities adjacent to neighborhoods and urban residential complexes within the formula of promotional housing. Thus, this research paper aims to research the content of the promotional housing formula and present the most important positives resulting from adopting this formula, and clarifying the role of real estate developers in the process of constructing housing according to this formula, and clarifying the agencies and public bodies approved to organize the construction process, in addition to shedding light on the content of the contract resulting from the residential formula in light of.
