الحق في النفاذ إلى المعلومة كأساس لتفعيل مبدأ المشاركة: البلديّة نموذجا

Résumé: يهدف هذا البحث لتبيان مفهوم الحق في النفاذ والولوج إلى المعلومات الإدارية ووسائل تكريسها في القانون الجزائري لا سيما في قانون البلدية، كونها دعائم أساسية لتسهيل سبل مشاركة الجمهور في تسيير شؤونه المحلية على مستوى البلدية. كما ترمي الدراسة لتسليط الضوء على العراقيل التي تحد من إعمال الحق في النفاذ إلى المعلومة، وتعرقل مشاركة المخاطبين بهذا الحق في الانخراط في مقاربة تسيير الشؤون العامة على مستوى المجالس الشعبية البلدية، من قبيل محدودية مجال الاطلاع على المداولات البلدية، وانعدام قنوان مشاركة الجمهور في تفعيل حق النفاذ في إطار المشاركة في تسيير الشؤون المحلية على مستوى البلدية. The legislator recognized the right of access to information in national law as the central pillar of the participation of citizens in the conduct of their local affairs and the establishment of participatory democracy, especially at the level of the municipal people's councils, as the basis of decentralization and the legal space most appropriate for the exercise of citizenship. The purpose of this research paper is to clarify the content of the right to access information and its tools in national law, how to activate it by citizens in the local management approach, and the limits that impede its effective implementation in order to achieve effective participation in the management and management of public affairs. : :
