حماية الممتلكات الثقافية على ضوء قواعد القانون الدولي

Résumé: الملخص: إن الممتلكات الثقافية هي الممتلكات المنقولة أو الثابتة ذات الأهمية الكبرى لتراث الشعوب الثقافي كالمباني المعمارية أو الفنية منها أو التاريخية، الديني منها أو الدنيوي، والأماكن الأثرية، ومجموعات المباني التي تكتسب بتجمعها قيمة تاريخية أو فنية، والتحف الفنية والمخطوطات والكتب والأشياء الأخرى ذات القيمة الفنية التاريخية والأثرية، وكذلك المجموعات العلمية ومجموعات الكتب الهامة والمحفوظات ومنسوخات الممتلكات السابق ذكرها. وكذا المباني المخصصة بصفة رئيسية وفعلية لحماية وعرض الممتلكات الثقافية المنقولة، كالمتاحف ودور الكتب الكبرى ومخازن المحفوظات وكذلك المخابئ المعدة لوقاية الممتلكات الثقافية المنقولة في حالة نزاع مسلح. فضلا عن مراكز الأبنية التذكارية التي تحتوي مجموعة كبيرة من الممتلكات الثقافية. يبدو أن الممتلكات الثقافية من خلال هذا المفهوم تستوجب حماية دولية، وهو ما سيكشف عنه موضوع الدراسة من خلال عرض العديد من الاتفاقيات والمعاهدات الدولية التي تعنى بحماية الممتلكات الثقافية منذ 1907 إلى غاية 2007. Abstract : Cultural property is the movable or immovable property of great importance to the cultural heritage of peoples, such as architectural, artistic or historical buildings, religious or secular, archaeological sites, groups of buildings that in their combination acquire a historical or artistic value, artifacts, manuscripts, books and other objects of historical artistic value. and archaeological sites, as well as scientific collections, important book collections, archives and reproductions of the aforementioned property. As well as buildings intended primarily and effectively for the protection and display of movable cultural property, such as museums, major bookstores and archives, as well as caches intended for the protection of movable cultural property in the event of armed conflict. As well as the centers of memorial buildings that contain a large collection of cultural property. It seems that cultural property through this concept requires international protection, which will be revealed by the subject of the study through the presentation of many international conventions and treaties concerned with the protection of cultural property from 1907 to 2007.
