واقع الخدمة ما بعد البيع في القانون الجزائري (تحديات وآليات)

Résumé: تعتبر الخدمة ما بعد البيع ضمانا اضافيا يلتزم به المتدخل لحماية الزبائن (المستهلكين) من العيوب التي تظهر في الاجهزة او الآلات الحديثة بعد استعمالها من قبل المستهلك. كما تعد من الحوافز الاساسية المساعدة على كسب رضاه وتوسيع قاعدة المستهلكين للمطالبة بها. لقد تم تنظيم هذه الخدمة في القانون رقم 09-03 المتعلق بحماية المستهلك وقمع الغش لكن الواقع العملي يظهر عدولا كبيرا عن تنفيذها من قبل المتدخلين بسبب نقص الرقابة في الميدان وجهل اغلبية المستهلكين لهذا الحق. Abstract: after-sales service is an additional guarantee that the intervener must commit to protecting the customers (consumers) from defects that appear in modern devices or machines after their use by the consumer. It is also considered one of the main incentives to help gain satisfaction and expand the base of consumers to demand. This service has been regulated in Law No. 09-03 related to consumer protection and the suppression of fraud, but the practical reality shows a great reversal of its implementation by the interveners due to the lack of oversight in the field and the ignorance of the majority of consumers of this right.
