إستخدامات الذكاء الإصطناعي على ضوء قواعد المسؤولية المدنية The Uses Of Artificial Intelligence In Light Of The Rules Of Civil Resbonsibility

Résumé: We live in a new age devoid of humanity an age that bears the term artificial intelligence there is no room for humans or not need them. The AI surpassed human intelligence wich occupied a more central position in various fields, and AI given the characteristics it carries, it does not mean that there are no negatives that harm the bodies, money and security of people. The reason for this research is to search for the legal system of civil responsibility resulting form the use of artificial intelligence techniques and the legal effects resulting form violating them when there are not explicit laws in Algerian legislation orgnisting this technology. Despite difficulties that we find as researchers in the field of legal sciences, However we have assigned it to the general rules of civil law, which have not been effectively regulated in reducing the risks of AI. أصبحنا نعيش في عصر جديد يكاد يخلو من الانسانية، عصر يدعى في ثناياه بالذكاء الاصطناعي لامحل فيه للبشر ولا للحاجة اليهم في كل القطاعات، تفوق وسبق الذكاء البشري مما يحتل مكانة أكثر مركزية في شتى المجالات، ويثار اهتمامنا نحن في هذه الدراسة مجالات الحياة اليومية للانسان القانونية. ونظرا لما يحمله من خصائص ومميزات هذا لا يعني أنه قد يتسبب في حدوث أضرار للاشخاص قد تمسهم في جسدهم، أموالهم، أمنهم، سلامتهم.مما يدفعنا في هذه الورقة البحثية للبحث عن النظام القانوني للمسؤولية المدنية الناشئة عن استخدام تقنيات الذكاء الاصطناعي والاثار والقانونية الناجمة عن الاخلال بها، في ظل عدم تواجد نصوص صريحة في التشريع الجزائري منظم ومعترف بهذه التقنية، وبالرغم من هذه العرقلة التي تقف أمامنا كباحثين في ميدان العلوم القانونية الا اننا قمنا بإسنادها للاحكام العامة المنصوص عليها في القانون المدني، التي لم تحط بعد بشكل كامل وفعال في مواجهة المخاطر والاضرار التي تسببها أنظمة الذكاء الاصطناعي.
