جريمة التنمر السيبراني في ظل حماية حقوق الطفل والآليات القانونية الرادعة لها - دراسة مقارنة بين التشريع الجزائري والفرنسي والمصري –

Résumé: تهدف هذه الدراسة الحالية لتسليط الضوء على صور التنمر السيبراني، و الآثار الناجمة عنها لفئة معينة و هي الفئة العديمة الأهلية أو ذات الأهلية الناقصة و الحماية المقررة لها في إطار تفعيل اتفاقية حقوق الطفل، و أيضا المسؤولية الجنائية المقررة للطفل في حال ما إذا كان يكتسي صفة الجاني في جريمة، نظرا للإقبال الرهيب للطفل على وسائل التواصل الالكترونية و ضعف الوازع الأخلاقي و الديني المشهود في الآونة الأخيرة ، و الكشف عن أهم الآليات القانونية للوقاية و الحد من انتشار هذا النوع من الجرائم في العالم الرقمي، وفي إطار ذلك قمنا بدراسة مقارنة بين الأنظمة الثلا النظام الوطني والنظام الفرنسي والمصري إضافة إلى المنهج الوصفي و التحليلي . This current study aims to highlight images of cyberbullying, as well as its implications for a particular group, namely the incompetent, in addition to the protection envisaged for it in the framework of the operationalization of the Convention on the Rights of the Child. The study also addresses the criminal responsibility of the child if he is the perpetrator of the crime, owing to the child’s tremendous access to electronic media and the recent weak moral and religious conscience, as well as detecting the most important legal mechanisms for preventing and curbing the spread of this type of crime in the digital world. In this context, we have studied a comparison between the three systems: the national, French, and Egyptian systems, using the descriptive and analytical approach in the study.
