حماية الطفل الموقوف للنظر في التشريع الجزائري

Résumé: تهدف دراسة موضوع حماية حقوق الطفل الموقوف للنظر لتسليط الضوء على الأحكام العامة للتوقيف للنظر في ظل التشريع الجزائري ، من خلال الشروط و حالات التوقيف الطفل خلال مرحلة التوقيفه ، و كذا تسليط الضوء على الحقوق للطفل الموقوف للنظر من خلال الحقوق المتعلقة بسلامته ، و الحقوق المتعلقة بالاتصال به . و بعد دراستنا للموضوع توصلنا لنتائج أهمها أن المدة القانونية لتوقيف للنظر رغم خفضها مقارنة بما هو مقرر بالبالغين إلا أنها لا تزال طويلة و أن إتمام الإجراءات بدون محامي عند تخلفه يقلل من توفير حماية للطفل . Abstract: One of prominent and fundamental elements with the study of the right of the arrested child is to shed light on the primary rules of the arrested child in the Algerian legislation .indeed ithe study is carried out to highlight the conditions as well as the reasons that permit child arrest .Also , the paper’s ai mis to put an emphasis on the pivotal right tha children possess with regard to their psychological and physical wellness . Despite , the fact that the megal period for child arrest is not that long, it is still long when compare’to that of the adults .furthermore, the absence of the lawyer may generate in turn a major absence of children rights.
