حق الطاعة بين الإلغاء والإبقاء

Résumé: تهدف هذه الدراسة لبيان الموقف الحقيقي للمشرع الجزائري من حق الطاعة الزوجية، والتنبيه إلى الفراغ القانوني الذّي أوجده على مستوى نصوص قانون الأسرة إثر التعديل الأخير الذي استحدثه عليه بموجب الأمر رقم 05-02 سنة 2005 بإلغائه نص الم 39 المتعلقة بحق الطاعة، وما يطرحه من إشكالات عديدة داخل الأسرة وفي المجتمع ككل، بالإضافة إلى توضيح مختلف الآثار المترتبة عن ذلك خصوصا تقصير النّاس وتفريطهم في هذا الحق الثابث والمبدأ الأساسي المقرر شرعا، لجهلهم به، وبحكمه الشرعي، وبدوره الفعال في تحقيق سعادتهم الزّوجية. This study aims to clarify the real position of the Algerian legislator regarding the right to marital obedience, and to alert to the legal void that he created at the level of family law texts following the recent amendment he made to them pursuant to Order No. 05-02 of 2005 by repealing the text of Article 39 related to the right to obedience, and the many problems that it poses within the family and in society as a whole. In addition to clarify its various effects , In particular, people’s defaulting and neglecting this fixed right and basic principle prescribed by Sharia, due to their ignorance of it, its legal ruling, and its effective role in achieving their marital happiness .
