مكانة حق الطاعة وحق الاستئذان-كحقّ مشترك- في قانون الأسرة الجزائري وأثر اتفاقية سيداو

Résumé: تمّ تعديل قانون الأسرة الجزائري سنة 2005 بالأمر رقم: 05-02، الذي يلاحظ عليه التأثر باتفاقية سيداو والتوجه نحو تحقيق المساواة بين الزوجين، ومن مظاهر هذا التأثر إلغاء المادة 39 التي كانت تقرر وتنصّ حق القوامة للزوج وحقه في الطاعة. ومن هنا تظهر أهمية هذه الورقة البحثية التي تهدف إلى معرفة مصير حق الطاعة وحق الاستئذان بعد إلغاء المادة 39. The Algerian Family Law was amended in 2005 by Order 05-02, which was notably influenced by the CEDAW convention and aimed to achieve equality between spouses. One manifestation of this influence was the repeal of Article 39, which previously established the husband's authority and right to obedience. Hence, the significance of this research paper lies in examining the fate of the right to obedience and the right to seek permission following the elimination of the husband's obedience duty and his headship over the family.
