القيمة القانونية للبلوك تشين في الإثبات ودوره في نطاق التوثيق الرقمي للمعاملات الإلكترونية

Résumé: ملخص: لقد واءم المشرع الجزائري مواكبتا منه للثورة التكنولوجية الأحكام المتعلقة بوسائل الإثبات مع ما يترتب عن هذه الثورة من نتائج وتمثل ذلك في تنظيم مجال المعاملات والمبادلات الإلكترونية، بالقانون 05-10 المعدل والمتمم للقانون المدني، وبإصداره قانون التوقيع والتصديق الإلكتروني 15-04، والذي تلاه قانون التجارة الإلكترونية 15-08، والمرسوم التنفيذي رقم 16-142 المحدد لكيفيات حفظ الوثيقة إلكترونيا، فأمام ظهور المحررات الإلكترونية، وما لها من دور في تسهيل المعاملات، كان من اللازم على المشرع التدخل لتعديل منظومة الإثبات لتستوعب هذه التقنيات الحديثة، إلا أن الأمر لم يتوقف هنا فقد ظهرت تقنية أخرى هي البلوك تشين فرضت نفسها وأثارت مشكلة حجيتها في مجال الإثبات الرقمي، ومدى انطباق الشروط الفنية والقانونية لكل من الكتابة الإلكترونية والتوقيع الإلكتروني عليها. Abstract: The Algerian legislator, in keeping with the technological revolution, has harmonized the provisions relating to the means of proof with the consequences of this revolution. This was represented in organizing the field of electronic transactions and exchanges, with Law 10-05 amending and supplementing the civil law, and by issuing the Electronic Signature and Certification Law 04-15, which was followed by the Law E-commerce 08-15, and Executive Decree No. 16-142 specifying how to save the document electronically. In view of the emergence of electronic documents, and their role in facilitating transactions, it was necessary for the legislator to intervene to amend the evidence system to accommodate these modern technologies, but the matter did not stop Here, another technology appeared, Blockchain, which imposed itself and raised the problem of its authority in the field of digital proof, and the applicability of the technical and legal requirements for both electronic writing and electronic signature to it.
