مشروعية استخدام الوسائل العلمية الحديثة في الاثبات الجنائي

Résumé: ملخص: يقوم الاثبات الجنائي على البحث عن مرتكب الجريمة بغرض إنزال العقاب على الجاني مستخدما في ذلك المتاح من الوسائل القانونية التي ينبغي أن تواكب تطور الأساليب الاجرامية وتكفل للإنسان عدم المساس بحرياته الشخصية وسلامته الجسدية، وتمنعه من تقديم دليل ضد نفسه. لم تدخر أجهزة العدالة الجنائية جهدا في استخلاص الأدلة باعتماد الأساليب العلمية الحديثة كالتنويم المغناطيسي والبصمة الوراثية، واستخدام تقنيات الترصد الالكتروني من اعتراض للمراسلات وتسجيل للأصوات والتقاط للصور، يهدف هذا المقال إلى تحديد مشروعية استخدام هذه الوسائل، وقد اعتمد المنهج التحليلي من أجل ضبط النصوص المعالجة للوسائل العلمية وكذا إقرار القيمة الثبوتية للأدلة العلمية المستمدة منها، وعن النتيجة المتوخاة فقد خلص البحث إلى أهمية تحقيق التوازن بين مقتضيات المصلحة العامة ومكافحة الجريمة ووجوب ضمان مشروعية استخدام الأساليب العلمية والوسائل التقنية وفقا للضوابط الإجرائية والموضوعية، وبالطرق السليمة حتى لا تشكل انتهاكا لأصل البراءة وضمانات المتهم وخصوصيته. Abstract: Criminal evidence aims at inflicting the punishment on the offender by using available legal means, which require keeping pace with criminal methods development and ensuring the non- violation of one's personal freedoms and physical integrity, and the prohibition of self-incrimination. Criminal justice agencies strive to extract evidence by adopting modern scientific methods such as hypnosis, genetic imprinting electronic and surveillance techniques, for example, intercepting correspondence and recordings. This article aims to determine the legality of using these means. The analytical approach was adopted to control texts considering scientific means, and recognizing the evidentiary value of the scientific derived evidence. The study concluded that it is essential to achieve balance between requirements of the public interest and combating crime. More, ensuring using scientific methods in accordance with procedural and substantive conditions and in the right way that the presumption of innocence, guarantees of the accused and his privacy are not violated.
