حماية العمالة المهاجرة في ظل القانون الدولي لحقوق الانسان

Résumé: ملخص:تضمن هذا المقال دراسة الحماية الدولية المقررة للعمال المهاجرين من الانتهاكات التي ترتكب في حق هذه الفئة ، من خلال الصكوك الدولية لحماية حقوق الإنسان بصفة عامة و الصكوك الدولية الأخرى التي تهتم بحقوق العمالة المهاجرة أساسها الاتفاقية الدولية لحماية العمال المهاجرين و أفراد أسرهم لسنة 1990 ، وكذا الاتفاقيات الأخرى التي تمت في كنف منظمة العمل الدولية ،بالإضافة إلى تحديد الآليات القانونية المتاحة لكفالة حماية هذه الحقوق ،مع الخلاصة إلى إعطاء مجموعة من المقترحات القانونية التي بإمكانها إعطاء أكثر فعالية لتجسيد هذه الحماية في إطار القانون الدولي لحقوق الإنسان تكمن أهمية دراسة الموضوع ، في حق الشعوب في الانتقال من مكان لآخر من اجل البحث عن الحياة الأفضل في إطار العمل في الدول الأجنبية ، الذين يحتجون لحماية قانونية من اجل قيامهم بذلك دون التعرض للانتهاكات والمعاملات غيرا أخلاقية ، و تقابلها أحقية الدولة الأجنبية المستقبلة التي تسعى إلى حماية أقاليمها من الأجانب و خاصة منهم غير شرعيين سواء جاؤوا من اجل العمل أو غير ذلك ، و حماية اقتصادها الوطني و فرص العمل لمواطنيها من قبضة الأجانب الذين يسعون للعمل بأي طريقة و تحت أي ظرف . Abstract This article is a study of the International protection stated for to the immigrated employeers from violations committed against them , through the International structures of Human Rights protection in general , and the other International organisms which are interested by the immigrated employeers rights ,its basis, the International Convention of the immigrated employeers protection and their family members of 1990, also the other convention which were done under the International Labor Organization ; As well as the determination of the available legal suggestions which can give a set legal suggestions we can give a more effectiveness to embody this protection as part of the International Law of Human Rights. The importance of studying the subject lies in the peoples ,right in moving from a place to another one looking for a better life ,as part of working in foreign countries who are protesting for a legal protection to do this without being exposed to violations and unethical treatment ; and it is faced with the eligibility of the receiving foreign country which seek to protect its territories from foreigners ; especially the illegitimate ones ;whether they are coming for other reasons ; and protecting its national economy and job opportunities for its citizens from the grip of foreigners who seek to work in any way and under any circumstance
