سلطة ضبط الصفقات العمومية وتفويضات المرفق العام كألية لحماية المال العام

Résumé: تضمن المرسوم الرئاسي رقم 15-247 استحداث سلطة ضبط في الصفقات العمومية وتفويضات المرفق العام، إلا أنه لم يبين تشكيلتها وتنظيمها وسيرها، ولم يمنحها استقلالية حقيقية من الناحيتين العضوية والوظيفية، بالمقارنة مع باقي سلطات الضبط المستقلة. غير أنه بخصوص الصلاحيات فقد منحت بموجب المادة 213 من المرسوم الرئاسي 15-247 بعض الصلاحيات والتي يغلب عليها الطابع الاستشاري، إذ لم يمنحها سلطة التحري وتوقيع العقوبات وسلطة التحكيم والفصل في النزاعات بين المتعاملين الاقتصاديين. Presidential Decree No. 15-247 included the creation of a control authority in public deals and public utility delegations, but it did not clarify its composition, organization, and functioning, nor did it give it real independence in both membership and functional terms, compared to the rest of the independent control authorities. However, with regard to powers, it was granted, under Article 213 of Presidential Decree 15-247, some powers which are predominantly consultative in nature, as they were not granted the power to investigate and impose penalties and the power to arbitrate and adjudicate disputes between economic dealers.
