النظام القانوني للتراخيص المنجمية في التشريع الجزائري

Résumé: الملخص: نظرا للأهمية البالغة التي يحتلها قطاع المناجم من الناحية الاقتصادية ونتيجة للأخطار الكبيرة التي يمكن أن تنجم عن استغلال الثروات المنجمية، سواء على البيئة والمحيط أو على أمن وسلامة الأشخاص، فإن المشرع الجزائري خص النشاط المنجمي، بمنظومة قانونية مستقلة واشترط لممارسته، وجوب الحصول على الترخيص المنجمي وعليه فان النظام القانوني للترخيص المتعلق بالنشاط المنجمي، يخضع الى مجموعة من الأحكام والضوابط، تساهم بشكل أو بآخر في إعطاء خصوصية ينفرد بها هذا الأخير، من حيث شروط منحه ومرفقات طلب الحصول عليه ومن حيث الآثار القانونية التي تنتج عنه ومن ثمة كان لزاما البحث في هذه الأحكام بشيء من التفصيل، لاسيما وأن القانون الساري المفعول رقم 14/05 المتضمن قانون المناجم، لم تصدر له نصوص تطبيقية إلا سنة 2018. Abstract: In view of the great importance that the mining sector occupies from an economic point of view and as a result of the great dangers that can result from the exploitation of mining wealth, whether on the environment and the environment or on the security and safety of people, the Algerian legislator singled out mining activity, with an independent legal system and stipulated for its practice, the necessity of obtaining a mining license. Accordingly, the legal system for the licensing of mining activity is subject to a set of provisions and controls, which contribute in one way or another to giving the latter a uniqueness in terms of the conditions for granting it and the attachments for obtaining it and in terms of the legal effects that result from it, and from there it was necessary Research these provisions in some detail, especially since the applicable law No. 14/05, which includes the Mining Law, did not issue any applicable texts until the year 2018.
