تطبيق العرف الدولي المتعلق بحقوق الإنسان في النظام الانجلوساكسوني

Résumé: تتبنى الدول الأنجلوساكسونية نظرية الفقيه الانجليزي بلاك ستون فيما يتعلق بإدماج العرف الدولي المتعلق بحقوق الإنسان، والتي مفادها أن "قانون الأمم يشكل جزء من القانون الوطني"، والتي تظهر لنا للوهلة الأولى أنها تعتمد المقاربة الأحادية بهذا الخصوص، لكن بالرجوع إلى الواقع العملي، فإننا لا نجد أن تطبيق العرف الدولي المتعلق بحقوق الإنسان يظهر بتلك البساطة، وهذا نظرا إلى غموض القاعدة العرفية بصفة عامة وصعوبة إثبات وجودها. فإن كانت معظم الدول الأنجلوساكسونية تعترف بالتطبيق المباشر للعرف الدولي، باستثناء استراليا التي يظهر أنها تتبنى المقاربة الثنائية في ذلك، ونفس الشيء بالنسبة لبريطانيا التي تشترط وجود نص قانوني في حالة تطبيق العرف الدولي الجنائي، فإنها في ذات الوقت تضع استثناءات على هذا التطبيق منها وجود نص قانوني مخالف. . وإن كان القاضي الأنجلوساكسوني يملك السلطة الكبرى في تطبيق العرف الدولي المتعلقة بحقوق الإنسان وتفسيره، فهو ملزم بالخضوع إلى القانون الوطني المخالف في حالة عجزه عن تفسيره بما يتوافق مع القواعد الدولية، بل أكثر من ذلك قد يستبعد القاضي الوطني العرف الدولي المتعلق بحقوق الإنسان، إن لم يكن في مصلحة بلاده، لذا نجده في الغالب يعتد برأي السلطة التنفيذية في تفسيره للقواعد العرفية؛ وبذلك مبدأ الفصل بين السلطات في الواقع لا يكون أبدا فصلا مطلقا، فالسلطة القضائية إن كانت ملزمة بتطبيق ومراعاة الالتزامات الدولية، فهي في ذات الوقت ملزمة بتطبيق إرادة دولتها................................................... The Anglo - Saxon countries adopt the English jurist Black Stone ’s doctrine that applies to the integration of the customary international law of human rights according to which “ the law of nations is a part of the national law”. One appears t o notice from the very beginning that they adopt a monistapproach in this respect. But with reference to reality, one come to find that the implementation of the customary international law of human rights sounds very simplistic due to the ambiguous customary rule in general and the difficulty to prove its existence. If most of the Anglo-Saxon countries acknowledge the direct application of customary international law, except for Australia that seems to adopt the dualist approach as well as Britain that requires a legal rule in case of implementing the criminal customary international law, they put forward at the same time some exceptions to this implementation among which an opposite national legal rule. If the Anglo - Saxon judge detains the greatest power in the application and interpretation of the customary international law of human rights, he is to be, however, subjected to the opposite national law if he fails to interpret it in connection with the international rules. Furthermore, the national judge may exclude the customary international law of human rights if it goes against his country’s interests. That is why one notices that he always adopts the executive power in interpreting the customary international rules. Hence the principle of power separation in reality is never absolute. If the judicial power has to apply and respect the international obligations , it, has at the same time, to apply its country’s will.
