إيداع الأحكام القضائية للشهر بالمحافظة العقارية. -بين القانون والتطبيق-

Résumé: تعتبر الأحكام القضائية سندا قويا في إثبات الملكية العقارية سواء تعلق منها بنقل ملكية عقار أو حقوق عينية عقارية، أو تعديل أو فسخ أو إبطال للحقوق العينية العقارية، أي تغيير يحدث في الملكية العقارية، والأحكام القضائية المثبتة للملكية العقارية لا يكون لها أثر بين الأطراف ولا في مواجهة الغير إلا من تاريخ إتمام إجراءات الشهر المحدثة لتلك الأوضاع. وتبدأ عملية شهر الأحكام القضائية بإيداعها بالمحافظة العقارية، فيقوم المحافظ العقاري بمراقبتها ومراجعتها واتخاذ قرار بقبول إيداعها أو رفضها، والاختصاص الأصيل في إيداع الأحكام القضائية يعود لكاتب الضبط، وإذا كان الموثق يتولى عند الاقتضاء مهمة إيداع الحكم القضائي، فمن المفروض تقيده بنفس التزامات كاتب الضبط في هذا المجال. لذا حاولنا من خلال هذه الورقة البحثية دراسة قابلية الحكم القضائي للإيداع، والإشكالات التي تثيرها عملية الإيداع بالمحافظة العقارية قصد شهره. Abstract: In general, judicial rulings are considered as strong bond in proving real estate ownership, whether related to the transfer of ownership of real estate or, real rights in real estate, or modification, termination or invalidation of real estate rights. Hence, any change that occurs in real estate ownership, and judicial rulings proving real estate ownership have no effect between the parties nor in Confronting others except from the date of completing the procedures of the month that updated these situations. On the other hand, the process of publicizing judicial rulings begins by depositing them in the real estate governorate. Besides ,the real estate governor monitors ,and reviews them takes a decision to accept or reject their deposit. Yet, the original jurisdiction in filing judicial rulings belongs to the seizure clerk. this field. In conclusion, we tried through this research paper to study the susceptibility of the judicial ruling to deposit, and the problems raised by the deposit process in the real estate governorate in order to make it public.
