الإيداع الجزئي للأحكام والقرارات القضائية المتضمنة قسمة العقار الشائع في التشريع الجزائري

Résumé: يجوز للشخص المالك على الشيوع فرز نصيبه الشائع لوحده عن طريق اللجوء إلى القضاء ورفع دعوى الخروج من الشيوع وعليه فان هذا البحث يهدف إلى إبراز الضوابط الإجرائية والتشريعية المتبعة حتى يتحقق إنتقال الملكية للشخص الذي يريد فرز نصيبه الشائع ونتيجة لذلك وفضلا عن كون الأحكام القضائية الممهورة بالصيغة التنفيذية والقرارات القضائية النهائية تتمتع بطابع الرسمية إلا أن إنتقال الملكية العقارية للشخص الذي يريد فرز نصيبه لوحده لن يتحقق إلا إذا كان الحكم القضائي نهائيا مع ضرورة إشهاره بالمحافظة العقارية إلا أن معظم الأحكام القضائية غالبا ما تكون محل رفض إيداع حيث تتضمن نقص في بعض البيانات الضرورية لإشهار الحق العيني لذلك يتعين على القضاة مراعات كافة النقائص التي تحول دون إشهاره . The person who owns the common may sort out his common share alone by resorting to the judiciary and filing a lawsuit to leave the common. Therefore, this research aims to highlight the procedural and legislative controls in place until the transfer of ownership is achieved to the person who wants to sort out his common share. However, the transfer of real estate ownership to the person who wants to sort out his common share will not be achieved unless the judicial ruling inscribed with the executive formula and final judicial decisions ،However, most judicial rulings are often the subject of refusal to file, as they include a lack of some data necessary to publicize the real right. Therefore, judges must take into account all the shortcomings that prevent its publicity.
