المسؤولية المدنية عن الروبوتات ذات الذكاء الإصطناعي

Résumé: تهدف هذه الدراسة الى بيان أحكام المسؤولية المدنية عن الأضرار الناشئة عن روبوتات الذكاء الإصطناعي، ومدى كفايتها في مواجهة هذه الأضرار وتقدير التعويض عنها، بالإضافة الى دراسة إمكانية منح الروبوتات الذكية الشخصية القانونية والإعتراف له بها مع إظهار موقف المشرع الجزائري من ذلك، وقد توصلت هذه الدراسة الى لمجموعة من النتائج والإقترحات أهمها أن أحكام المسؤولية المدنية التقليدية ينتابها القصور وغير كافية لحماية المتضررين وتعويضهم عن الأضرار التي لحقتهم بسبب تطبيقات الذكاء الإصطناعي، بالإضافة الى ضرورة تعديل درجة المسؤولية المدنية، بحيث يتم إعتماد الشخص الحريص بدلا من معيار الشخص المعتاد في ‘طار المسؤولية التقصيرية، واعتبار الإلتزام في العقد إلتزام بتحقيق نتيجة وليس بذل عناية في إطار المسؤولية العقدية. الكلمات المفتاحية: الذكاء الإصطناعي، الروبوت الذكي، المسؤولية المدنية، النائب الإنساني، :Abstract This study aims to demonstrate civil liability provisions for damages arising from Robots as well as examining the possibility of granting and recognizing legal personal AI while demonstrating Algeria position on this. This study has produced a series of conclusions and recommendations, the most important of which was that traditional civil liability provisions were inadequate and insufficient to protect and compensate those affected for damage caused by robot. In addition to the need to adjust the degree of civil liability, so that the standard of a careful person under tort. The contractual obligation is considered as an obligation to achieve a result and not to exercise care under contractual liability.
