أثر رقابة المطابقة على حماية الحقوق والحريات العامة بعد التعديل الدستوري 2020

Résumé: ملخص: تعتمد المحكمة الدستورية المستحدثة بموجب التعديل الدستوري الجزائري 2020 مكان المجلس الدستوري على عدة آليات رقابية بصفتها أعلى هيئة دستورية أنيط بها حماية الدستور بالإضافة إلى حماية الحقوق والحريات الأساسية التي كرسها من أي انتهاك أو انتقاص في ممارستها بعيدا عن الأطر القانونية التي وضعها. وتعد رقابة المطابقة أهم هذه الآليات الرقابية نظرا لوجوبية تفعيلها على القوانين العضوية والأنظمة الداخلية للبرلمان، والأوامر التشريعية التي يصدرها رئيس الجمهورية قبل إصدارها، وهي بذلك تهدف إلى حماية مبدأ سمو الدستور، وبهذا الدور فإن لرقابة المطابقة أثرا مباشرا على الحقوق والحريات الأساسية إذا ما أحيل تنظيمها على القوانين العضوية التي تتميز بخصوصية أنها امتداد للدستور وتعبير عن روحه، وبهذا الوصف تمنع اعتداء المشرع على هذه الحقوق والحريات التي كرسها الدستور من سن أي قانون ينتهكها أو ينتقص منها خلافا لمبادئ الدستور. Abstract: The Constitutional Court, created by the Constitutional Amendment of Algeria 2020, relies on the place of the Constitutional Council as the highest constitutional body entrusted with the protection of the Constitution, as well as the protection of fundamental rights and freedoms enshrined in it against any violation or derogation from the legal framework established by it. Conformity control is the most important of these oversight mechanisms, given that they must be implemented in accordance with the organic laws, the rules of procedure of the Parliament and legislative orders issued by the President of the Republic prior to their promulgation, are aimed at protecting the principle of the primacy of the Constitution. In this regard, the control of conformity has a direct impact on fundamental rights and freedoms, if the organization of which is referred to in organic laws, which are characterized as an extension of the Constitution and an expression of its spirit.
