.تكريس الحق في البيئة والتنمية المستدامة في التعديل الدستوري2016

Résumé: خطا المؤسس الدستوري الجزائري خطوة مهمة في مجال الحقوق البيئية والتنمية المستدامة من خلال نصه صراحة على حماية البيئة وحق المواطن من العيش في بيئة سليمة والحصول على تنمية مستدامة ويظهر ذلك من ديباجة التعديل الدستوري لسنة 2016 في المادة 68 التي نصت صراحة على حق المواطن في بيئة سليمة ونظيفة. جاءت ضرورة حماية هذا الحق من طرف الدولة ومؤسساتها وتحديد واجبات الأشخاص تجاه هذا الحق وبهذا يكون التعديل الدستوري 2016 أول نص دستوري تبنى حماية الحق في بيئة سليمة وكفل بالنص على حمايته من طرف الكل، سواء الدولة أو المؤسسات العمومية أو الأشخاص المعنويين أو حتى الأشخاص الطبيعيين بحيث نصت المادة 68 في فقرتها الأخيرة على دسترة الحماية لهذا النوع من الحقوق. وبناء على هذا تكون الجزائر قد فتحت عهداً جديداً في مجال الحقوق والحريات بدسترة الحق في البيئة والتنمية المستدامة موازاة مع بناء اقتصاد تنافسي دون المساس بالبيئة لضمان مستقبل الأجيال اللاحقة. The Algerian constitutional founder took an important step in the field of environmental rights and sustainable development through its explicit provision to protect and the right of the citizen to live in a healthy environment and to obtain sustainable development. And the need to protect this right by the state and its institutions and determine the duties of people towards this right, and thus the 2016 constitutional revision will be the first to adopt protection of the right in a safe environment and the text guarantees its protection by everyone, whether the state, public institutions, legal persons or even natural persons so that the article stipulates 68 in its last paragraph on the constitutionality of protection for this type of rights. Based on this, Algeria has opened a new era in the field of rights and freedoms by examining the right to the environment and sustainable development in parallel with building a competitive economy without compromising the environment to ensure the future of subsequent generations
