الأحكام الموضوعية و الإجرائية لنظام المحاكمة عن بعد على ضوء القانون 15-03

Résumé: بالعربية : تم إعتماد تقنيات الإتصال المرئي والمسموع في عدة مجالات، من بينها مجال العدالة، إذ أصبحت بعض المحاكمات تتم عن بعد كمظهر من مظاهر تطوير هذا القطاع وصدر بذلك القانون رقم 15/03 المتعلق بعصرنة العدالة، ومما لا شك فيه أن اللجوء إلى هذا الأسلوب المستحدث يحقق العديد من الفوائد فهي تضمن توفير الوقت والجهد، وكذا سرعة الفصل في القضايا المعروضة أمام مختلف الجهات القضائية.غير أن هناك من إعترض على أسلوب المحاكمة عن بعد لأنها قد تؤثر على ضمانات المحاكمة العادلة. وحتى يتفادى المشرع الجزائري هذا الإشكال وضع الشروط والأحكام التي تنظم هذا النوع من المحاكمات. والهدف من هذه الدراسة يتمثل في معرفة الأحكام التي وضعها المشرع الجزائري لنظام المحاكمة عن بعد، أما النتيجة المتوصل إليها فهي أن اللجوء للمحاكمة عن بعد يساعد على إضفاء نوع من التطور في قطاع العدالة بشرط أن تراعى فيها ضمانات المحاكمة العادلة. بالإنجليزية Abstract: Visual and audiovisual communication techniques have been adopted in several areas, including the field of justice, Some trials have come to take place remotely as a manifestation of the sector's development and Law No. 15/03 on the modernization of justice has been passed unquestionably, the use of this innovative method has many benefits: it ensures time and effort. as well as the expeditious disposition of cases before various judicial bodies. There are others who object to remote trial because it may affect fair trial guarantees. In order to avoid this problem, Algerian legislators should establish the terms and conditions governing this type of trial. The purpose of this study is to learn about the provisions of Algerian legislation on the system of remote trial, while the conclusion is that the use of remote trial helps to bring some kind of development in the justice sector, provided that fair trial guarantees are taken into account.
