المراقبة الإلكترونية في السياسة الجنائية للتشريع الجزائري: تعزيز للرقابة القضائية وإجراء بديل للعقوبة

Résumé: يشكل نظام المراقبة الإلكترونية كإجراء لتعزيز الرقابة القضائية للمتهم أو باعتباره إجراء بديلا عن العقوبة بالنسبة للمحكوم عليهم تطورا هاما في مجال عصرنة نظام العدالة الجنائية. فهو إجراء يدعم إجراءات الرقابة القضائية أثناء فترة التحقيق القضائي، كما أنه إجراء بديل عن العقوبة المنطوق بها حيث يسمح للمحكوم عليه قضاء كل العقوبة أو جزء منها خارج المؤسسة العقابية. من خلال ذلك، نحاول في هذه الورقة البحثية أن نتطرق إلى هذا النظام الجديد من حيث اعتباره تعزيزا للرقابة القضائية من جهة، وإجراء بديلا للعقوبة من جهة ثانية. Abstract: Electronic monitoring system is an important development in the modernization of the criminal justice system. It is a measure to strengthen the judicial control of the accused, as well as an alternative measure of punishment for convicts. It supports the conduct of judicial control procedures during the judicial investigation period, and is an alternative procedure to the sentences handed down where the convicted person is allowed to serve all or part of the sentence outside the penitentiary institution. This paper discusses this new system in terms of strengthening judicial control on the one hand and an alternative measure of punishment on the other.
