اختصاص مجلس الدولة الجزائري بالنظر في منازعات المرافق العامة المهنية منظمة المحامين أنموذجا

Résumé: تعتبر المرافق العامة المهنية على غرار منظمة المحامين، مرافق حديثة النشأة ظهرت مع التطور الذي عرفته وظيفة الدولة، حيث أوكلت لها مهمة تأطير وتنظيم ومراقبة المهنة مستخدمة في ذلك بعض امتيازات السلطة العامة. ففي إطار ذلك تصدر هذه المنظمة جملة من القرارات الفردية والتنظيمية التي قد تثور حولها منازعات، فمنح المشرع صلاحية النظر فيها لجهة القضاء الإداري لاسيما مجلس الدولة الذي ينظر في اغلب هذه المنازعات باعتباره قاضي درجة أولى وأخيرة، قاضي استئناف، وقاضي نقض. غير أن ممارسة مجلس الدولة لاختصاصاته بالنظر في هذه المنازعات يقضي على مبدأ التقاضي على درجتين المقرر دستورا، فلا يمكن استئناف القرارات الصادرة عنه، كما لا يمكنه الفصل بطريق النقض في القرارات النهائية الصادرة عنه باعتباره هيئة استئناف استنادا إلى الكثير من اجتهاداته. Professional public service, such as the Lawyers Organization, are newly established service that emerged with the development of the state’s function, as it was entrusted with the supervision, regulation and control of the profession, using some of the privileges of the public authority. The organization is a set of individual and organizational decisions that may arise disputes, the legislator has given the power to consider them for the administrative judiciary especially the State Council, However, the State Council exercise its jurisdiction to consider these disputes eliminates the principle of two-tier litigation as decided by a constitution. The decisions issued by it cannot be appealed, and it cannot decide by way of cassation on the final decisions issued by it as an appeals body based on many of its jurisprudence
