طبيعة المجلس الدستوري الجزائري حسب التعديل الدستوري لسنة 2016 (دراسة مقارنة بالمجلس الدستوري الفرنسي)

Résumé: يتناول المقال إحدى أهم الاشكاليات المرتبطة بجهاز المجلس الدستوري في الجزائر،وهو تحديد طبيعته،حيث انقسم الفقه بشأنها بين من يؤيد فكرة أن المجلس جهاز قضائي،ومن يرى أن المجلس الدستوري هو هيئة غير قضائية، كونها تميل الى الطبيعة السياسية،ولم يبد المؤسس الدستوري الجزائري موقفا حاسما من المسألة رغم التعديلات الدستورية التي مست المجلس الدستوري،إلى حين صدور التعديل الدستوري لسنة 2016،أين نستشف منه أن المؤسس الدستوري الجزائري يصبغ المجلس الدستوري بصفة المؤسسة الدستورية العليا والمستقلة،وهو موقف نرى أنه يتجاوز الخلاف الدستوري التقليدي القائم بشأن هاته المسألة.
