ضمانات عزل الموظف العام بسبب إهمال المنصب

Résumé: ملخص: يعدّ عزل الموظف العام من الوظيفة العامة، أخطر إجراء إداري يتعرّض له الموظف الذي أهمل منصب عمله، حيث يؤدي ذلك الإجراء إلى حرمانه من الضمانات التأديبية من جهة، ويحرم أيضا من التوظيف مستقبلاً من جهة ثانية، هذا ما جعل المشرع الجزائري يحدد الضوابط الموضوعية والإجرائية التي تنظّم إجراء عزل الموظف المهمِل لمنصب عمله، ذلك بموجب المرسوم التنفيذي رقم 17-321. منح ذات المرسوم مجموعة من الضمانات للموظف العام في مواجهة قرار العزل. حيث شملت ضمانات تسبق قرار العزل، وضمانات تتعلق بالقرار ذاته، وضمانات بعد تنفيذ قرار العزل. The dismissal of a public official who neglected his job in the public service; is the most serious administrative procedure, which excommunicates him from disciplinary guarantees on the one hand; and no future recruitment on the other hand, this what makes the Algerian legislator determines the substantive and procedural controls of the dismissal decision of a public official neglected his job, by Executive Decree N° 17-321. The decree granted to the public official some rights against the decision of dismissal, which included guarantees before the dismissal decision; guarantees related to the same decision and guarantees after the application of the decision.
